Recruiter Information and Terms of Engagement:

In all activities associated with permanent appointments, Top Connect (Pty) Ltd acts in the capacity of an AGENT for its client.The original CV of the candidate is forwarded to the client.Fees are based on a percentage of the Total annual cost to company or Total annual rand value benefit (whichever is greater) remuneration package offered to the candidate.

Recruiter Payment & Guarantee Policy:

1. Top Connect (Pty) Ltd will invoice on the day the recommended candidate commences employment with the client.


2. You validate the Top Connect (Pty) Ltd guarantee by making payment within fourteen (14) days of date of invoice.Guarantee for purposes hereof shall have the meaning set out as below:Our guarantee is only validated on receipt of payment on or before the fourteenth (14th) day from the date of invoice of the recommended placement. Kindly note: it is the client’s full responsibility to ensure that Top Connect (Pty) Ltd has received the payment for the placement within the set period. If you validate your guarantee and the candidate leaves your employment within the guarantee period (60 days) for any reason other than retrenchment, disablement, unfair dismissal, death, unfair labour practices or the client no longer wishes to fill the said vacancy, Top Connect (Pty) Ltd offers to find a suitable replacement candidate. Top Connect (Pty) Ltd is to be given the opportunity to replace the candidate free of charge, however, should a suitable candidate not be found, 100% will be credited to your account for future placements. No monetary refund will be affected – Top Connect will credit your account for future usage/placements.


3.  You may want to defer your hiring decision. Should you do so, and if Top Connect (Pty) Ltd.’s recommended candidate is hired within twelve (12) months of the referral day, Top Connect (Pty) Ltd is entitled to the full fee and will invoice accordingly.


4. It is a term of this agreement that you agree to pay Top Connect (Pty) Ltd the permanent appointment fee should you employ a candidate who has been introduced to you by Top Connect (Pty) Ltd, in any capacity i.e. permanent, on a contractual basis, a temporary basis, a consultative basis, or in any other capacity whatsoever, agreed upon between you and the candidate.


5. Should you introduce a Top Connect (Pty) Ltd referred candidate to any other company, subsidiary, or associate, you will be liable to pay the applicable placement fee should the candidate be employed by any of the above mentioned.


6. Should you refer any candidate through the services of Top Connect (Pty) Ltd to a third party, and in the event of the third party employing the candidate, then and in such an event, you shall remain liable to Top Connect (Pty) Ltd for the full fee as if you had employed the candidate.


7. You shall be liable for all legal costs on the scale as between attorney and own client including collection charges incurred by Top Connect (Pty) Ltd in the receipt of fees and any other costs owing by you to Top Connect (Pty) Ltd.
